STATUTORY COMPLIANCE. MONITORING AND REPORTING

  • The ownership and operation of buildings entails civil and criminal responsibilities. Being on top of the large number of specific regulations applicable, is critical to manage risks and costs. Preventing accidents is not only a duty of any landlord and employer, but can mean the ruin of any company in case of an accident. It is the duty of any landlord to make the building safe, in order to do so, there are a large number of regulations applicable and in constant revision. Among other duties, contracting a competent person can often be challenging, as it implies a high degree of specific knowledge and experience.

  • It is advisable to make sure that the contractors have the relevant qualifications to safely do the job they are intended to do. The landlord and operator are finally accountable and at risk of serious sentences including confinement and fines.

  • Every stage of the life cycle of a building, has associated duties and documents, e.g.: design, construction, operation, use, demolition, disposal, management, etc.

​

  • Contrary to common law, H&S regulation obliges the defendant to evidence innocence. In order to do so, they must have records of compliance with all applicable statutory duties.
